JAMES D. MURTHA, ESQ. – Managing Member  (e-mail James D. Murtha)

James D. Murtha is a Managing Member of MURTHA & MURTHA, PLLC, and heads the firm’s Landlord-Tenant Law, Debt-Collection Defense and Article 78 divisions.

Having successfully represented hundreds of landlords and tenants in the landlord-tenant courts of Nassau and Suffolk counties, Mr. Murtha’s reputation as an experienced landlord-tenant attorney is well known; and his expertise and depth of knowledge in landlord-tenant law make him highly sought by both landlords and tenants on Long Island.

Having also been a member of the consumer credit industry for over twenty-five years, and having held key positions in several of the nation’s leading debt-collection firms, Mr. Murtha is also a highly experienced debt-collection defense attorney. With expertise in FDCPA, FCRA and HIPAA issues, Mr. Murtha has written and taught on the subjects and has successfully litigated cases in defense of consumers’ rights, protecting them from the unfair practices of debt-collection agencies, creditors, automobile dealerships, banks, student loan companies and other businesses in both state and federal courts.

James D. Murtha also specializes in bringing special proceedings under Article 78 of the Civil Practice Law and Rules in New York State Supreme Court and Second Amendment litigation in defense of the rights of law-abiding citizens to keep and bear arms, and against civil and criminal charges stemming from lawful firearms ownership and use, as well as litigation in defense of licensed firearms dealers in civil liability matters.  He is the author of the informational pamphlet, “Understanding Special Proceedings Under Article 78 of the Civil Practice Law and Rules” (2009).

In addition to his duties as a Managing Member of MURTHA & MURTHA, PLLC, Mr. Murtha has also devoted his time to teaching consumer debt classes and providing consumer education as a public service in association with the public library system of Suffolk County.

James D. Murtha earned his Juris Doctor degree at Hofstra University School of Law.  He is admitted to practice law in all the courts of the State of New York and in the United States District Court for both the Eastern and Southern Districts of New York.


MICHELE MURTHA, ESQ. – Of Counsel (e-mail Michele Murtha)

Ms. Murtha is of counsel to MURTHA & MURTHA, PLLC, and practices in the firm’s Intellectual Property, Civil Rights and Constitutional Law divisions.

She has successfully represented many clients in copyright matters in federal courts.  Her knowledge and expertise, particularly in the complex area of copyright infringement, has earned her a reputation for being a dedicated and skilled copyright attorney.  At MURTHA & MURTHA, PLLC, she represents clients in all areas of copyright law, but is renowned for being a passionate advocate of photographer’s rights.

Her legal expertise also extends to the area of Constitutional Law, in which she is dedicated to protecting parties whose constitutional rights have been violated. She litigates issues involving the infringement of constitutional rights in federal court, including by bringing claims under 42 U.S.C. § 1983 against state officers, governmental officials, municipalities and their employees for the depravation of any rights, privileges, or immunities secured by the Constitution of the United States.

Ms. Murtha earned a Bachelor of Music Degree in Professional Music from Berklee College of Music prior to beginning her career in the Business and Legal Affairs Department at Sony Music. She attended Hofstra University School of Law on an academic scholarship, where she earned her Juris Doctor Degree. After working as a bank attorney for several years with a large real estate firm, Ms. Murtha joined a large litigation firm as a trial associate, specializing in No-Fault litigation and personal injury defense, where she tried hundreds of cases, representing commercial clients, including major insurance companies in both state and federal court.

Ms. Murtha routinely lectures on Photographers’ Rights and Copyright matters to photographers groups in New York.  She has vast expertise in litigating cases in both trial courts and appellate courts, and at MURTHA & MURTHA, PLLC, she applies her knowledge and experience to providing clients with the highest level of counseling and representation.

Ms. Murtha is admitted to practice law in all the Courts of the State of New York, as well as the United States District Court for both the Eastern and Southern Districts of New York.
