Article 78 – Special Proceedings in New York State Supreme Court

ARTICLE 78 PROCEEDINGS

We initiate special proceedings in New York State Supreme Court under Article 78 of the Civil Practice Law and Rules to overturn the determinations of administrative agencies, bodies, or officers. These special proceedings are the formal mechanisms for challenging the determinations of any court, tribunal, municipal board, public corporation, or officer, including the Department of Motor Vehicles and all licensing authorities such as the handgun licensing officers designated by law, all state agencies and town boards.

The types of determinations for which we initiate Article 78 proceedings include denials of pistol license applications or applications for any government-issued license such as liquor licenses; suspensions or revocations of pistol or other licenses; denials of permits for zoning and special land use; denials of Freedom of Information Requests, and  determinations of town boards involving residential and commercial land use issues.
