James D. Murtha has been a member of the consumer credit industry for over twenty-five years, having held key positions in several of the nation’s leading debt-collection firms. As an expert in FDCPA, FCRA and HIPAA issues, Mr. Murtha has written and taught on the subjects and has successfully litigated cases in defense of consumers’ rights. In addition to his passion for consumer defense, Mr. Murtha is an outspoken advocate of Second Amendment issues and has championed the right to keep and bear arms in court.
Practicing in the courts of the State of New York, as well as in federal courts, Mr. Murtha focuses his efforts on consumer defense litigation, in which he protects the rights of consumers from the unfair practices of debt-collection agencies, creditors, automobile dealerships, banks, student loan companies and other businesses. He also specializes in bringing special proceedings in New York State Supreme Court and Second Amendment litigation in defense of the rights of law-abiding citizens to keep and bear arms, and against civil and criminal charges stemming from lawful firearms ownership and use, as well as litigation in defense of licensed firearms dealers in civil liability matters.
In addition to his duties as a Managing Member of MURTHA & MURTHA, PLLC, James D. Murtha also devotes his time to teaching consumer debt classes and providing consumer counseling and education as a public service in association with the public library system of Suffolk County.
MICHELLE MURTHA, ESQ. – Managing Member (e-mail Michelle Murtha)
Michelle Murtha earned a Bachelor of Music Degree in Professional Music from Berklee College of Music prior to beginning her career in the Business and Legal Affairs Department at Sony Music. She attended Hofstra University School of Law on an academic scholarship, where she earned her Juris Doctor Degree. After working as a bank attorney for several years with a large real estate firm, Ms. Murtha joined a large litigation firm as a trial associate, specializing in No-Fault litigation and personal injury defense, where she tried hundreds of cases, representing commercial clients including major car rental and insurance companies.
Prior to co-founding MURTHA & MURTHA, PLLC, Michelle Murtha was a managing member of The Hughes Law Firm, PLLC, which is nationally renowned for its litigation efforts in the field of intellectual property issues. In addition to her responsibilities as a managing member of MURTHA & MURTHA, PLLC, she also heads the firm’s intellectual property division.
Michelle Murtha is admitted to practice law in all the Courts of the State of New York, as well as the United States District Court for both the Eastern and Southern Districts of New York. She has litigated cases both in trial courts and in appellate courts, and is a trial and litigation expert. At MURTHA & MURTHA, PLLC, Ms. Murtha applies her knowledge and experience to providing clients with the highest level of counseling and representation.
